Terms of Service

The baseline terms for accessing and using OSMyan's website, merchant workspaces, and order management tools.

This page is a practical baseline for OSMyan and is not legal advice. Please have it reviewed by qualified counsel before relying on it for production or regulated use.

1. Agreement to these terms

These Terms of Service govern access to and use of OSMyan, including our website, waitlist, merchant workspaces, order management tools, inventory tools, invoice features, reporting features, and related services.

By accessing or using OSMyan, you agree to these terms. If you use OSMyan on behalf of a shop, company, or organization, you represent that you have authority to accept these terms for that organization.

2. The OSMyan service

OSMyan provides software for online shop operations, including order tracking, inventory management, invoice generation, customer records, logistics coordination, team workflow, reports, notifications, backups, and related operational tools.

We may improve, add, modify, suspend, or remove features over time. Some features may be offered as beta, preview, or early access features and may change before general release.

3. Accounts and workspace access

You are responsible for keeping account credentials secure and for all activity that occurs under your account or workspace.

Workspace owners and administrators are responsible for assigning appropriate roles and permissions to staff members and removing access when it is no longer needed.

You must provide accurate account, billing, shop, and contact information and keep it updated.

4. Merchant data and customer records

You retain ownership of the business data you enter into OSMyan, including orders, products, inventory, invoices, customers, delivery records, and reports.

You grant OSMyan permission to host, process, transmit, display, back up, and otherwise use merchant data as needed to provide and improve the service.

You are responsible for ensuring that you have the right to process customer personal information and business records in OSMyan.

5. Acceptable use

You may not use OSMyan to violate laws, infringe rights, distribute malware, spam, harass others, attempt unauthorized access, interfere with service integrity, or upload data you do not have permission to process.

You may not reverse engineer, scrape, overload, bypass access controls, or misuse APIs or integrations except as allowed by written documentation or our express permission.

6. Invoices, reports, and operational outputs

OSMyan may generate invoices, reports, summaries, exports, and other operational outputs based on data entered by users. You are responsible for reviewing outputs for accuracy before using them for business, accounting, tax, customer, or logistics decisions.

OSMyan is not a tax, accounting, legal, banking, or financial advisory service.

7. Payments and subscriptions

If paid plans are offered, fees, billing cycles, limits, renewal terms, and taxes will be described at checkout, in an order form, or in your account settings.

Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.

8. Service availability and changes

We aim to keep OSMyan reliable, but we do not guarantee uninterrupted or error-free operation. Downtime may occur due to maintenance, updates, network issues, third-party providers, security incidents, or events outside our control.

We may suspend access if we believe an account creates security risk, violates these terms, harms the service, or creates legal exposure.

9. Confidentiality and security

Each party should protect non-public information received through the service using reasonable care. You should configure staff access carefully and avoid sharing credentials.

If you suspect unauthorized access to your account or workspace, notify us promptly at contact@osmyan.com.

10. Disclaimers

OSMyan is provided on an as-is and as-available basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

You are responsible for verifying important business records, maintaining appropriate backups or exports where needed, and deciding whether OSMyan fits your operational requirements.

11. Limitation of liability

To the maximum extent permitted by law, OSMyan and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm.

To the maximum extent permitted by law, our total liability for claims relating to the service will be limited to the amount you paid to OSMyan for the service during the three months before the event giving rise to the claim, or USD 100 if no fees were paid.

12. Termination

You may stop using OSMyan at any time. We may suspend or terminate access if you violate these terms, create risk, fail to pay applicable fees, or use the service in a way that may harm OSMyan or others.

After termination, we may retain or delete workspace data according to our Privacy Policy, backup practices, legal obligations, and operational requirements.

13. Changes to these terms

We may update these terms as OSMyan changes. If changes are material, we will take reasonable steps to notify users through the website, app, or other contact methods. Continued use after changes become effective means you accept the updated terms.
